Terms and Conditions

§ 1 Scope and Contracting Party
These Terms and Conditions apply to all contracts for digital products (symptom packages), printed books and services (for example the personal analysis) offered via bodysignal.app. The free newsletter is not a paid product; its use is governed by the privacy policy.
The contracting party is Wise Lifestyle LTD, 36 St Dminka Street, Victoria (Gozo), VCT9030, Malta, registered in the Malta Business Registry under C 92030 (hereinafter the “Provider”).
§ 2 Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue. By clicking “Order with obligation to pay” you submit a binding offer. The Provider accepts the offer by sending an order confirmation by email.
§ 3 Prices and Payment
All prices are inclusive of the applicable statutory value added tax. Payment is made via the payment methods offered during checkout (credit card, SEPA, etc.) through our payment service provider Stripe.
§ 4 Provision of Digital Content
After successful payment, access to the purchased symptom texts is unlocked in the app immediately. The digital content is readable exclusively within the app and cannot be downloaded (copyright protection).
Printed books are dispatched to the delivery address you provide after individual order fulfilment. Delivery times are stated during checkout.
§ 5 Right of Withdrawal and Its Expiry
As a consumer, you generally have a 14-day right of withdrawal from the conclusion of the contract, without giving reasons.
Expiry for digital content: For digital content, your right of withdrawal expires once we have begun performance of the contract after you have
- expressly consented to performance beginning immediately, and
- confirmed that you thereby lose your right of withdrawal (§ 356 para. 5 BGB / Art. 16 lit. m Consumer Rights Directive).
We obtain this declaration during checkout by means of a separate checkbox.
For printed books, the standard 14-day right of withdrawal applies. You will receive the withdrawal instructions together with the order confirmation.
§ 6 Ownership and Usage Rights
All content (symptom texts, audio, images, software) is protected by copyright. With your purchase you acquire a simple, non-transferable right of use for personal purposes.
Reproduction, redistribution, publication or commercial use of the content is not permitted without the express written consent of the Provider.
§ 7 Liability and Health Disclaimer
BodySignal provides psychosomatic interpretations and impulses for self-reflection. These are no substitute for a medical diagnosis or treatment. In the case of acute or chronic health complaints, please consult a qualified doctor, Heilpraktiker (state-licensed practitioner of natural medicine) or therapist.
The Provider is liable without limitation for intent and gross negligence. For slight negligence, the Provider is liable only in the event of a breach of essential contractual obligations and limited to the foreseeable damage typical for such contracts.
§ 8 Data Protection
The processing of your personal data is governed by the Privacy Policy.
§ 9 Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): ec.europa.eu/consumers/odr. We are neither obliged nor willing to take part in a dispute resolution procedure before a consumer arbitration board.
§ 10 Applicable Law and Place of Jurisdiction
The law of the Republic of Malta applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.
The exclusive place of jurisdiction for all disputes arising from contractual relationships between the customer and the Provider is the Provider’s registered office, provided that the customer is a merchant or a legal entity under public law.
§ 11 Final Provisions
Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The statutory provision shall take the place of the invalid provision.
